1INTRODUCTION & ACCEPTANCE OF TERMS

By accessing and using this website and placing orders, you agree to be bound by these Terms and Conditions. These terms constitute a binding agreement between you and BH Design Co. If you do not agree, please refrain from using this website.

3DEFINITIONS

  • "Business", "We", "Us", "Our" refers to BH Design Co.
  • "Customer", "You", "Your" refers to the person accessing this website or placing an order.
  • "Personalised/Custom Products" means products made to your individual specifications including custom prints, engraved items, embroidered products, bespoke gifts.
  • "Website" refers to www.bhdesignco.co.za
  • "Order" means a request submitted by you to purchase products.
  • "POPIA" means the Protection of Personal Information Act 4 of 2013.
  • "CPA" means the Consumer Protection Act 68 of 2008.
  • "ECTA" means the Electronic Communications and Transactions Act 25 of 2002.

4PRODUCTS & SERVICES

We offer personalised and custom-printed gifts and products made to your individual specifications. Product descriptions, images, and previews on this website are for illustrative purposes. Colours may vary slightly from screen to actual printed product due to monitor calibration and printing processes.

We reserve the right to decline orders at our discretion. All products are subject to availability.

5ORDERING PROCESS

  • Orders are placed through our website/via email/WhatsApp as indicated.
  • You will receive an order confirmation via email once your order is accepted.
  • A digital proof/mockup will be provided for approval before production commences (where applicable).
  • Production only begins upon receipt of your written approval of the proof.
  • Changes to orders after proof approval may result in additional charges.
  • The contract is concluded when we receive payment in our bank account.

6PRICING & PAYMENT

  • All prices are displayed in South African Rand (ZAR).
  • Prices exclude VAT as we are currently not registered for VAT.
  • We reserve the right to change prices without prior notice.
  • Payment is required in full before production commences unless otherwise agreed in writing.
  • Accepted payment methods: YOCO Payment link or EFT.
  • Proof of payment must be sent to info@bhdesignco.co.za for EFT payments.

7DELIVERY & SHIPPING

  • Delivery is available nationwide across South Africa via our courier partners.
  • Estimated delivery times are provided at checkout and in your order confirmation — these are estimates only.
  • Delivery fees are calculated based on your location and order size and displayed at checkout.
  • We are not liable for delays caused by courier companies, public holidays, or circumstances beyond our control.
  • Risk passes to you upon delivery of the goods to the courier.
  • Please inspect your order upon receipt and report any damage within 48 hours.
  • In terms of ECTA Section 46, we will execute orders within 30 days of confirmation unless otherwise agreed.

8PERSONALISED & CUSTOM PRODUCTS — IMPORTANT

Exemption from Cooling-Off Period

Due to the bespoke and personalised nature of our products, personalised and custom orders are generally EXEMPT from the standard 7-day cooling-off period provided under Section 44 of ECTA and the CPA, as these goods are made to your individual specifications and cannot be resold.

It is your responsibility to ensure all personalisation details (spelling, names, dates, artwork) are correct before approving your proof. We are not liable for errors in personalisation details provided by you.

Non-personalised standard products may be returned subject to our Returns Policy in Section 9.

9RETURNS, REFUNDS & CANCELLATIONS

  • PERSONALISED PRODUCTS: Due to their custom nature, personalised and custom products cannot be returned or refunded unless they are defective or not as approved in your proof.
  • DEFECTIVE PRODUCTS: If your product arrives damaged or defective, please notify us within 48 hours of receipt with photographic evidence. We will repair, replace, or refund at our discretion in line with the CPA.
  • NON-PERSONALISED PRODUCTS: Subject to a 7-day return period from date of receipt. Products must be unused, in original packaging. Return shipping costs are the customer's responsibility unless the product is defective.
  • CANCELLATIONS: Orders may be cancelled before proof approval with a full refund. Cancellations after proof approval but before production may incur a 30% administration fee. Cancellations after production has commenced will not be refunded.
  • Refunds will be processed within 7–14 business days to your original payment method.
  • Your rights under the CPA (Consumer Protection Act 68 of 2008) are not affected by these terms.

10INTELLECTUAL PROPERTY

All content on this website including logos, images, designs, text, and graphics are the intellectual property of BH Design Co. or our licensors. You may not reproduce, distribute, or use any content without our prior written consent.

By submitting artwork, images, or designs to us, you warrant that you own the intellectual property rights or have permission to use them, and you indemnify us against any third-party IP claims. Custom designs created by us for your order remain the intellectual property of BH Design Co. unless otherwise agreed in writing.

11CONSUMER RIGHTS UNDER THE CPA

These terms do not limit your statutory rights under the Consumer Protection Act 68 of 2008. You have the right to receive goods of good quality, in good working order, free of defects. You have the right to fair, honest dealing and disclosure.

Complaints may be directed to the National Consumer Commission (NCC) at www.thencc.org.za or 012 428 7000.

12LIMITATION OF LIABILITY

We shall not be liable for any indirect, special, or consequential damages arising from your use of our website or products. Our total liability to you shall not exceed the purchase price paid for the specific order in question.

We are not liable for delays or failures caused by circumstances beyond our reasonable control (force majeure) including load-shedding, natural disasters, courier failures, or civil unrest. We do not warrant that our website will be uninterrupted or error-free.

13WEBSITE USE & DISCLAIMER

This website is provided on an "as is" basis. We make no warranties regarding the accuracy or completeness of information on this website. We reserve the right to modify or discontinue the website at any time. You are prohibited from using our website for unlawful purposes, spamming, or any activity that could harm our systems.

14PRIVACY

Your personal information is processed in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA). Please read our Privacy Policy which forms part of these Terms and Conditions.

15GOVERNING LAW & DISPUTE RESOLUTION

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising shall first be referred to mediation/negotiation.

If unresolved, disputes shall be subject to the jurisdiction of the Magistrate's Court or High Court of South Africa as appropriate. For consumer disputes, you may also approach the Consumer Goods and Services Ombud (CGSO) at www.cgso.org.za.

16AMENDMENTS

We reserve the right to amend these Terms and Conditions at any time. Continued use of the website after amendments constitutes acceptance of the updated terms. The date of last update is indicated at the top of this document.
